  • If no description is provided, the goods are considered compliant if they are suitable for the purpose communicated by the customer to the seller at the time of the contract and agreed upon by the seller.

Customer Rights (Statutory Warranty)

  • If the goods turn out to be defective, the customer has the right to demand the seller to eliminate the defect (free repair or replacement, price reduction) or to terminate the contract;
  • Repair and replacement are the primary rights of the customer. The customer may demand free repair or replacement unless it is impossible due to the nature of the goods or requires disproportionate or excessively high costs;
  • The goods must be repaired or replaced within a reasonable time so as not to cause significant inconvenience to the customer. Maximum repair time: 30 calendar days. Maximum replacement time: 10 working days;

    b) The seller fails to repair or replace within a reasonable time and the customer loses interest in performance;
    c) Repair or replacement would cause significant inconvenience to the customer.
  • The customer may claim compensation for damages caused by non-performance under Georgian law;

When assessing whether costs are disproportionate, the following will be considered:

b) Degree of non-compliance;
c) Possibility of eliminating the defect without significant inconvenience to the customer.

  • The customer may exercise these rights if a defect is found within 2 years of delivery;
  • If discovered within 6 months of delivery, it is presumed the defect existed at delivery unless proven otherwise. After 6 months, the burden of proof lies with the customer.

Liability of the Parties

  • Each party has the right to demand full, timely, and good-faith performance from the other;
  • Parties are liable to compensate each other for damages caused by full or partial non-performance or improper performance. Compensation does not release them from obligations.
