Customer Rights (Statutory Warranty)
-
If the goods turn out to be defective, the customer has the right to demand the seller to eliminate the defect (free repair or replacement, price reduction) or to terminate the contract;

b) The seller fails to repair or replace within a reasonable time and the customer loses interest in performance;
c) Repair or replacement would cause significant inconvenience to the customer. -
The customer may claim compensation for damages caused by non-performance under Georgian law;

When assessing whether costs are disproportionate, the following will be considered:
a) Price of the goods/service in case of compliance;
b) Degree of non-compliance;
c) Possibility of eliminating the defect without significant inconvenience to the customer.
-
The customer may exercise these rights if a defect is found within 2 years of delivery;
-
If discovered within 6 months of delivery, it is presumed the defect existed at delivery unless proven otherwise. In this case, the burden of proof lies with the seller. If discovered after 6 months, the burden of proof lies with the customer.
Liability of the Parties
-
Each party has the right to demand full, timely, and good-faith performance from the other;

Right of Withdrawal without Stating Reason
According to Article 13 of the Georgian Law on Consumer Rights Protection (except as provided in Article 14), the customer has the right to withdraw from a distance or off-premises contract within 14 calendar days without giving any reason.
This period is calculated from:
a) For service contracts – from the conclusion of the contract;
b) For sales contracts – from the moment the customer or a third party (other than the carrier) takes possession of the goods;
c) For multiple goods ordered separately – from the moment the customer or third party takes possession of the last item;
d) For regular deliveries of goods – from the moment the customer or third party takes possession of the first item.
Conditions for Return
-
The customer has 14 calendar days from delivery to request a return. After this period, the right to return expires;
-
To exercise the right, the customer must complete a return form (available on our website) and send it via email to ana.sh.fstyle@gmail.com or via private message to our Facebook page;
-
Upon withdrawal, the customer must return the goods immediately, but no later than 7 calendar days, and bear the direct costs of return;
-
If the goods do not match the description, have an initial defect, or are damaged during transport, the seller covers the return cost;
-
The customer must return the goods with all accompanying documents;
-
The seller must refund the amount paid within 14 calendar days of receiving the return request. The refund may be withheld until the goods are returned or proof of shipment is provided;
-
Refunds are made using the same payment method unless otherwise agreed;
-
Withdrawal automatically cancels the associated contract and restores the original state;
-
The customer cannot withdraw from goods/services priced at less than 30 GEL.
Force Majeure
-
Neither party is liable for failure to perform obligations caused by natural or technological disasters, fire, war, or government actions that began or developed after the order was placed;

-
The affected party must inform the other party of the circumstances, expected duration, and termination;
-
These facts must be confirmed by the competent authority of the region (chamber of commerce, industry, etc.);
-
Failure to notify or delay in notification deprives the party of the right to invoke force majeure as grounds for exemption from liability.
